4. LENGTHS AHEAD LA SOFTWARE
LENGTHS AHEAD LA is the owner of, and has absolute title to all of the software used on or in conjunction with, or referred to, on this Site, including but not limited to all Guessing and Tipping software and software relating to Guessing and Tipping competitions (“LENGTHS AHEAD LA Software”).
5.GUESSING AND TIPPING COMPETITIONS
This Site offers you the opportunity Input and manage your own Guessing and Tipping competition. In respect of any Guessing and Tipping competition set up on this Site or any other website using LENGTHS AHEAD LA Software (“Guessing and Tipping Competition”), Guessing and Tipping Competition will be manager (“Manager”) By LENGTHS AHEAD LA and will be responsible for the way in which the Guessing and Tipping Competition is run. On setting up a Guessing and Tipping Competition, the Manager will be assigned a unique uniform resource locator (or URL) that provides access to a Guessing and Tipping page (“Guessing and Tipping Page”). The Guessing and Tipping Page is unique to that Guessing and Tipping Competition and is the medium through which the Manager and all participants of that Guessing and Tipping Competition can join, tip, check results and consult with the leader board. Upon joining a Guessing and Tipping Competition where the Manager has set an entry fee to be paid online, each participant in the Guessing and Tipping Competition will be required to pay the entry fee for that Guessing and Tipping Competition, as designated by the Manager (“Payer”). LENGTHS AHEAD LA will hold all money provided by each Payer (“Guessing and Tipping Competition Money”) until the conclusion of the Guessing and Tipping Competition and upon the conclusion of the Guessing and Tipping Competition, LENGTHS AHEAD LA will distribute all Guessing and Tipping Competition Money to the Guessing and Tipping Competition winner(s), as determined by LENGTHS AHEAD LA Software and authorised by the Manager. For the avoidance of doubt, LENGTHS AHEAD LA holds Guessing and Tipping Competition Money on behalf of Guessing and Tipping Competition participants as an agent only. LENGTHS AHEAD LA is not responsible for or liable to anyone for distributing Guessing and Tipping Competition Money as authorised by the relevant participants who do it as a group . LENGTHS AHEAD LA will undertake checks to ensure accuracy does not warrant any errors that occur outside of LENGTHS AHEAD LA responsibilities that results of a Guessing and Tipping Competition will always be accurate and LENGTHS AHEAD LA takes no responsibility if the results are inaccurate or not available for any reason. Credit card transaction charges are added to the competition fee that competition participants pay online to join a particular competition. The credit card charge amount is displayed on the relevant competition joining page.

LENGTHS AHEAD LA has unfettered discretion in relation to the Guessing and Tipping Pages, including but not limited to unfettered discretion in relation to all advertising that may appear on the Guessing and Tipping Pages from time to time.
6.1 Competitions administered by LENGTHS AHEAD LA
All “members who join a competition managed by, “LENGTHS AHEAD LA” the competition administered by LENGTHS AHEAD LA .
LENGTHS AHEAD LA Guessing and Tipping competitions are conducted on the www.LengthsAhead.com.au website and are open to members of the general public. The competitions are free of charge. Competition prize winners will be determined by the scores on the competition leader board after being updated to reflect results of the final racing event relevant to the competition. o Official racing results taken from the relevant racing authority will be used to determine the outcome of a race for a competition. o In the event that more than one Member has an equal score for a scoreboard ranking which corresponds to a prize, then the total sum of prizes allocated to the ranks of the collective group of Members with equal scores will be split between these Members. For example if three Members get an equal score and appear at the top of the leader board, then the prizes for first, second and third are pooled and shared equally amongst the three winners, where the Guessing and Tipping is Take the Whole Pot the customer that has the highest points at the last race is declared the winner, if the races are partially finished and the meeting is abandoned the winner/s will collect the prize
7. GUESSING AND TIPPING
You agree to provide tips and other information relevant to horse racing, harness racing and or greyhound racing that accurately represent your views and opinions. The tips and information that you provide to the site must be solely your own and not those of other persons or parties. LENGTHS AHEAD LA reserves the right to cancel your use of the site if it deems you have violated this condition. Sales that you make from selling your tips on the site include relevant taxes, credit card processing fees and commission. Monies payable to you (“guessing payable balance”) are equal to the total of net sales less LENGTHS AHEAD LA commission. Net sales are calculated by subtracting relevant taxes if applicable (e.g. GST) and credit card processing fees from the tip package sale price. LENGTHS AHEAD LA commission rate applied to the purchase/sale of your tips equals 20% of the ticket sale price. LENGTHS AHEAD LA reserves the right to modify the commission amount at any time. The payable balance is paid on the next working day allowing for banking clearance times Standard time, Australia, payment will deduct any monies that are owing if this event occurs. In the event of unforeseen operational issues or acts of God which prevent payment processes from being performed, LENGTHS AHEAD LA reserves the right to delay payments to you without any liability for costs or other consequential loss associated with delayed payment. LENGTHS AHEAD LA commits to take measures available to them to resolve the issues restricting payment within a reasonable timeframe. Payments are made by bank deposit into your bank account according to the details that you provide to us. You are responsible for providing accurate personal details including name, surname, address and bank account details to be used for depositing funds into your bank account. LENGTHS AHEAD LA reserves the right to deduct costs associated with fees charged by banks caused by incorrect banking information provided by you.
7.1 POINTS ALLOCATION TO EACH GUESS- POINTS AND TAB PRICE POINTS
4 points for selecting the winner/s (1st) adding the WIN value of the New South Wales TOTE price
3 points for selecting the second place (2nd) adding the 2nd PLACE value of the New South Wales TOTE price
2 points for the guess that runs third (3rd) adding the 3rd PLACE value of the New South Wales TOTE price
1 point for the guess that runs fourth (4th) ONLY.
7.1 POINTS ALLOCATION TO EACH GUESS -POINTS ONLY
As the user of the LA TIPPING application this option can be selectable and the corresponding value will be allocated to the competition participants.
In case of a dead heat each horse selection will be allocated full points 1st , 2nd, 3rd , and or 4th respectively.
In the case of a scratching prior to the race and at the barriers the substitute will be the NSW TAB will be the horse known as the “SUBSITUTE”
8. PRIZES
Guessing and Tipping Competition winners are authorised and confirmed by the Manager for the relevant Guessing and Tipping Competition. LENGTHS AHEAD LA is responsible for identifying the relevant competition winner or allocating prizes to participants of Guessing and Tipping Competitions undertaken through this Site. The Payer is the participant who is eligible, under these Terms and Conditions, to receive prize money in respect of a particular winning entrant in a Guessing and Tipping Competition. LENGTHS AHEAD LA may distribute cash prizes to Payers who are designated as Guessing and Tipping Competition winner(s) by the Manager by way of bank deposit into the competition winner’s nominated bank account. Effective distributions of cash prizes by LENGTHS AHEAD LA to Guessing and Tipping Competition participants is therefore dependent on LENGTHS AHEAD LA being provided with correct and accurate bank details by the Payer during the claim process. LENGTHS AHEAD LA takes no responsibility for non-payment of any prize by LENGTHS AHEAD LA to a Guessing and Tipping Competition winner, including where LENGTHS AHEAD LA has been provided with incorrect or invalid bank account details. In the event that the Manager has failed to authorise payment to the Guessing and Tipping Competition winner(s) ten (10) days after the Competition End Date, LENGTHS AHEAD LA will distribute the prize money payable to the Guessing and Tipping Competition winner(s) by reference to the leader board for that Guessing and Tipping Competition and such distribution will be deemed to have been authorised by the Manager.
9. GUESSING AND TIPPING INFORMATION TRADE PROMOTION
Users, of the site, can purchase your ticket for tips posted to the site by , using Visa or MasterCard, PAYPAL, Direct Transfer or BPAY. “The price” paid when confirming a tip purchase will be the price specified on the site. You are required to confirm your intention to buy the ticket guessing tips and enter your payments details. After you perform these steps on LENGTHS AHEAD LA the credit card or account that you elect to pay with, will be charged the price. All sales are non-cancellable and final. You understand that the price includes relevant taxes (e.g. Goods and sales tax), processing fees, commissions to LENGTHS AHEAD LA and fees to the seller. The Guessing and Tipping information that you purchase will be emailed to the email address that you provide to the site and posted to your ‘Purchased Tips’ page. In the event that you do not receive an email with the Guessing and Tipping information that you purchase, which may result from email filter blocks, incorrect email addresses or other technical issues outside of LENGTHS AHEAD LA control, you should check your junk folders to receive your purchased information. The Guessing and Tipping information that you purchase is a single license to you, giving you the right to use the information for your personal recreational purposes only. You are not permitted under any circumstances to re-sell, publish, forward, communicate to another individual, use to represent your own tips on the site or any other medium, or derive any commercial benefit from the Guessing and Tipping information that you purchase. WE DO NOT MAKE ANY WARRANT AS TO THE RESULTS TO BE OBTAINED FROM THE PURCHASED INFORMATION. WE DO NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. 13. REFUNDS
If you post tips on the site, you understand that you are “the tipper”. If you buy a guessing competition entry (“the buyer”) you have entered into a transaction with LENGTHS AHEAD LA . LENGTHS AHEAD LA is the provider of the site, a portal to list, advertise and market and display your selections tips and a payment mechanism to assist sale activities on the site. Transactions on the site are exclusively between you and LENGTHS AHEAD LA . It is the buyer’s sole responsibility to determine their legal entitlements for a refund or return from purchases made on the site. Any dissatisfaction with any product or service purchased from the site should be addressed with LENGTHS AHEAD LA . The tipper agrees to reimburse LENGTHS AHEAD LA for all costs and expenses incurred by LENGTHS AHEAD LA in suppling funds to the guessing competition, made for products and services purchased from the site. LENGTHS AHEAD LA reserves the right to refund a buyer for purchases made. In instances where LENGTHS AHEAD LA chooses to refund payments, LENGTHS AHEAD LA will not be liable to the seller for the refunded sale. LENGTHS AHEAD LA reserves the right to deduct monies from payments to the seller for any transaction costs incurred from refunding the buyer for the seller’s tips. If the tips you purchase from a seller do not contain at least one official runner or participant (as determined by the officiating authority of the event) resulting from a guess of the “the tipper” is scratched at the time of the race and lockout the “tipper” will be allocated the NSW TAB substitute which is normally the favourite or nominate horse by the NSW TAB, abandoned races, or other means, LENGTHS AHEAD LA will refund the buyer the full price of the guessing competition tips purchased. LENGTHS AHEAD LA reserves the right to deduct any transaction costs incurred from the refund. There are no refunds offered for Guessing and Tipping competitions. Once you have paid your Guessing and Tipping competition fee it is final and non-cancellable. If you pay your Guessing and Tipping competition fee and you are the only tipper in the competition you must claim your competition fee as a prize using LENGTHS AHEAD LA prize claim process at the end of the Guessing and Tipping competition.
Each deposit which is not used for purchases or turned over as part of an operating guessing account will be charged any banking fees applicable when administration fee when it is cashed out or refunded.
14. LINKS TO OTHER SITES
The Site may contain links to other websites which are owned or operated by third parties (“Third Party Sites”). These links are provided for convenience only. Links on the Site to Third Party Sites may not be current and are not indicative that Third Party Sites are being maintained and/or updated. 25.DEAD HEATS- Dead-heats: prizes
This Rule applies in the event of two players running a dead-heat for any place in connection with which a prize would otherwise be distributed in accordance with this Part.
All prizes to which each category of Persons connected with the first and second places and would have been entitled must be divided equally between such Persons.
Applies to the division of any prize, whatever the number of dead-heaters and whatever the place for which the dead-heat is run.
When this event occurs, and it happens during a live game the Wild Card points allocated will be voided if a participants get their Wild Card up.
Wild Cards will be void, this means that the points will revert to normal points and the doubling of points where allocated will be voided.
The participants points will not have a Wild Card point allocated, the highest points at the last race competed prior to the abandoning of the race meeting will be declared the winner where there is a another game current that game will proceed to the end and the highest points and place getters will be declared the winner and the game will end.
27.POSTPONED MEETINGS
The points from a Postponed meeting will rollover to the time and date declared by the host of the race meeting,
In the event where a meeting is postpone and rescheduled and, the original meeting has commenced with races results and declared correct weight those points and Wild Card will carry over to the postponed meeting.
If a participant has selected a Wild Card in an early race that has resulted and correct weight declared and the meeting in question will be and has been postponed and the participant has played his Wild Card can play only have one (1) Wild Card and participants do not get the opportunity to select another one in the postpone meeting, as per normal, a player only gets one (1) Wild Card and the carry over meeting constitutes the same meeting , this means if you selected a Wildcard in a race card that has raced and resulted participants do not get to select another one in the new location or meeting
If the meeting in question has once again postponed LENGTHSAHEAD will declare the game over at the last race run and reset and void all Wild Card point and revert to single normal points without the Wild Card doubling, meaning no wild card doubling of points and all points revert to normal points and the games winner will be declared and that being the participants leading with the most points at that time.

– Submit and agree to T&C’s. You will get a copy of your tips via email.
– TAB win and place odds are converted into points. These go towards your overall score.
– Picking a winner gets you a combined win and place points added to your total.
– Picking 2nd or 3rd gets you place points added to your total.
– Points are allocated based on the final “all paying” notification from TAB.
